Dad faces charge of DWI with child, 3, in car

A Baldwin father was charged with driving while intoxicated while his 3-year-old daughter was in the car, authorities said.

State police arrested Rafael D. Ramon, 42, who was driving a gray 2004 BMW X5 Saturday night. They said a trooper stopped Ramon, who was speeding on the Meadowbrook State Parkway northbound, near exit M5, in East Meadow.

The trooper interviewing Ramon detected an odor of alcohol, police said in a news release. They said Ramon failed sobriety tests during the 9 p.m. traffic stop and he was arrested. One of the three passengers in the car was Ramon’s daughter, who was in a rear child seat, state police said. She was turned over to a family member.

Police said in the release that Ramon’s blood alcohol level was .12 percent. He was charged with felony DWI — Leandra’s Law — as well as speeding. Leandra’s Law makes driving drunk with a child under age 15 in the vehicle an automatic felony.

Ramon was held pending arraignment at Nassau First District Court on Monday, where the case was continued and bond was set at $500 cash.
