Denenberg sentencing postponed to June 5

A federal judge will wait an extra two weeks to sentence Dave Denenberg, a former Nassau County legislator from Merrick, for defrauding a legal client of $2.3 million. His sentencing was scheduled for May 22, but the judge granted a requested delay until June 5.

While working for Manhattan law firm Davidoff, Malito and Hutcher — and later, for Davidoff, Hutcher and Citron — Denenberg billed a client, Port Washington computer company Systemax, Inc., for fictional legal work. He pleaded guilty to eight felony counts of mail fraud and resigned from office in January. He now faces up to 20 years in prison. Federal sentencing guidelines, however, call for 41 to 51 months. The decision rests with Judge Joanna Seybert of the U.S. District Court for the Eastern District of New York.

Last week, Denenberg’s lawyer, Joseph Russo, asked Seybert for more time to submit sentencing memorandums, according to court documents. Russo requested a new court date of June 5, and Seybert agreed, according to the documents.

Denenberg’s sentencing is now set for 11 a.m. on June 5 at the U.S. Courthouse in Central Islip.
