Long Beach woman charged with aggravated DWI

Driver had 15-year-old passenger in the car

Nassau County police arrested a Long Beach woman on Tuesday for driving while intoxicated with a minor in the car, a violation of Leandra’s Law.

Devon O’Neill, 19, was arrested in Island Park on Tuesday at 4 a.m. According to police, a NCPD fourth precinct officer observed a vehicle travelling southbound on Austin Boulevard drifting in and out of the lane. Police pulled over the car, and determined that O’Neill was under the influence of alcohol. She also had a 15-year-old passenger in the car.

O’Neill was charged with DWI, as well as two counts of aggravated DWI — one for violating Leandra’s Law and one for having a blood alcohol content that was more than double the legal limit of .08 percent — and failure to maintain lane.

Leandra’s Law, or the Child Passenger Protection Act, makes even a first offense DWI an automatic felony if a child age 15 or younger is in the car. She was arraigned on Tuesday at First District Court in Hempstead.
