Village settles 2009 lawsuit

The Valley Stream Board of Trustees on Nov. 16 approved a $90,000 settlement of a lawsuit filed by a man who suffered injuries when he fell outside of Village Hall in March 2009.

Wilson Descardes, who was 39 at the time, alleged that his foot got stuck in a gap in the building’s front steps, which caused him to fall and twist his leg, according to Michael Hopkins, an attorney for the village. Descardes required surgery on one of his quadriceps, Hopkins said, and if a settlement wasn’t reached the case would’ve likely gone to trial.

Descardes sued for pain and suffering, as well as medical expenses related to the injury, said his lawyer, Adam Feder. The settlement addressed all claims that were raised. Hopkins called the amount “reasonable.”

The village repaired the section of steps shortly after the incident, according to Village Clerk Bob Barra.
