Charges dismissed in alleged Cedarhurst assault and robbery

The alleged charges against Daniel, Dov and Jacob Avital of Cedarhurst for assault, robbery and other charges were dismissed on April 3.

In the letter all three Avitals received from the Nassau County District Attorney's office read that, "The above case in which you were the defeandant, has beem presented to a Nassau County Grand Jury, and the charges associated with the above-referenced docket number have been dismissed."  

The letter is signed by County DA Anne Donnelly.

Daniel,   36, Dov and Jacob, of Cedarhurst, were arrested for alleged assault and robbery among other charges on Sept. 11.

The victim, a 31-year-old man, called Five Towns Jewelry Buyers, at 589 Willow Ave., attempting to sell a bracelet, but was instructed to go to 542 Redwood Dr., due to the store being under renovation, detectives from the Nassau County Police Department said in a news release. 

When the man arrived at the Willow  Avenue address, he was allegedly forcibly grabbed and dragged into the home, beat, using a baseball bat and threatened with a sledgehammer by the alleged defendants. The three also allegedly stole the man's iPhone, bracelet and drivers license, then fled the scene, the NCPD said. 

It was learned that the man completely made up the story. The bracelet was found to be a Cartier fake.
