One "Hell" of a ball WH native accused in biker gang murder

      The first day of the annual Hellrazor's Ball, a celebration of biker culture sponsered in part by the Hell's Angels, looked like a success until just after 4 p.m. At that time, witnesses say about ten vans packed with members of the Pagans, a rival biker gang, rushed the entrance of the club. The Pagans then allegedly assaulted anyone in their way and were finally met with a flurry of gun fire.
      "All hell broke loose," said Herbert Faust, the Nassau County Police Department's chief of detectives. On Sunday, police displayed the types of weapons used in Saturday's brawl between the two rival gangs. Among them was a loaded uzi, a rusted machete and knives that were disguised as lipstick.
      Nassau County Police say they have a witness that places the gun in the hands of Dwyer, who police allege shot and killed 50-year-old Robert Rutherford, a one-time president of his local Pagan chapter. Rutherford, of Lancaster, Penn., was taken to North Shore University Hospital in Plainview and died from both a gunshot wound and a stab wound to the chest shortly after he was transported.
      Currently being held by police, Dwyer, 38, is pleading innocence.
      "At this time, his position is that he did not commit a crime," said Michael Dergarabedian, Dwyer's attorney. "Police are basically going on the statement of one witness and the weapon has not been recovered."
      Dwyer currently resides in a room behind Peters Tat - 2, a tattoo parlor located on Atlantic Ave. in Oceanside. An artist at the store denied knowledge of Dwyer's residence at the address, but Dergarabedian confirmed that his client resides there.
      According to police, five shots were fired during the melee, all coming from one gun. Along with Dwyer, 73 members of the Pagans gang were arrested and there were 95 arrests in all.
      Faust suggested that this could be the start of a turf war, but Dwyer's lawyer disagrees.
      "This was not about turf; I believe it was more about a grudge between two people," Dergarabedian said. The Rockville Centre lawyer said that after the melee, police received statements from over 80 people that were at the Hellrazor's Ball, and again stated that only one said they saw Dwyer firing shots.
      "We don't even know who it is," indicating it could be a member of the Pagans.
      "I have full confidence that my client will not be convicted," Dergarabedian. "He is confident that he will be exonerated."
